I was so impressed with M. Mosby that I watched the video again.
But if you look at it closely, are these charges really going to stick?
She says that the arrest was illegal. That may be true, but I've never heard of cops being prosecuted for illegal arrest.
She says that they failed to buckle him in and that violated an official rule. OK, but is that rule legally binding and has anyone ever been prosecuted for it.
Furthermore she doesnt necessarily have proof that the injury occurred in the van. What if the injury occurred during the arrest.
She says that some cops violated their duty by not providing a medic. Again, has any cop been prosecuted for this, and what is the actual duty of a cop in this regard? Couldn't the cop claim that they determined he did not need a medic?
I'm certainly pleased that they charge the cops, but its certainly going to be a sttep climb to gain convictions on these charges.
